We strive to make MathChimp, an advanced study tool designed to accelerate your online learning experience, a safe and secure user experience. This Privacy Policy is therefore designed to describe how we use, collect, disclose, and protect your personal information, and your choices associated with that data.


For the purpose of this Privacy Policy, the mathchimp.ai website (the "Site"), along with mobile applications, extensions, platform-specific applications, or other interactive features that post a link to this Privacy Policy (each one a “Service”), are collectively described herein as the “Services.” The Services are operated by OTM Technologies LLC, a Wyoming Corporation (referred to in the Privacy Policy as “OTM Technologies” or “we” or “our” or “MathChimp”). This Privacy Policy is in effect for the Services—including any web pages or mobile applications on which it is posted—e-mail lists, or other generic and personal information collected, retained, or received by OTM Technologies, no matter the method of collection (e.g., mail, survey, website use, or any feature of the Services). We use your data to provide and improve the Services. By using the Services, you agree to the collection and use of information in accordance with this policy.

Definitions

Usage Data: Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).


Data Controller: Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.

WHAT DO WE MEAN BY “PERSONAL INFORMATION”?

When you provide the information to us:

Registration and Profile Information. Upon your registration to use the Services, we may collect personal information including your e-mail address, password, date of birth, contact information and other identifying data. For obvious reasons, we need to do this in order to provide the Services to you. It is possible that OTM Technologies may also request additional (and optional) demographic information from you in order to provide more personalized engagement with the Services.


Communications Between Us. We may receive information that you provide in connection with a request to help you resolve a problem, or respond to a request. If and when we send you e-mails, it is possible that we may track whether you open the e-mail so that we can provide better service. You may provide us with questions, comments, suggestions, ideas, or other information (“Feedback”), which shall not be deemed to be personal or confidential, and we may use it and share it with third parties.

Job Search Information. Applicants seeking employment with OTM Technologies may submit their contact information and resume online through a dedicated link on our website, which will be visible when such jobs are available. We will collect the information you choose to provide on your resume, such as your education and employment experience.


Third-Party Credential Log-In. If you choose to connect to the Services using credentials from a third-party service like Google, we will collect authentication information and encrypted access credentials such as your Google account e-mail address, username, and profile photo. With your permission, we may also collect other information available on or through your third-party account. We use this information to identify your use of the Services. We do not transmit your authentication information or encrypted access credentials to our servers. We only store the content of documents you choose to transmit to us.


Information automatically collected when you use our Services: When you use our Services we use cookies and similar tracking technologies to collect information about your browser, your device, and other information about the way in which you connect to our Services. A cookie is a text file that is placed on your hard drive. We may use these technologies to:


· collect information about how visitors use the Services;

· support the features and functionality of the Services;

· improve our advertising and marketing efforts.


We may use both session cookies and persistent cookies. A session cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. Information automatically collected includes:


Location and Activity Information. Information about your estimated location which may be deduced by various technologies including your IP address.


Usage Information. This includes information such as your browser name, the type of computer used, as well as other technical information about how you connect to our Service. This information may include the operating system and the internet service providers utilized, mobile device information (phone model and version) and other related information.


Device Information. Information about the device you are using such as, model, operating system, application version number and browser, mobile network information, IP addresses, usernames, e-mail addresses and other device related properties.


Log Information. Server logs regarding how you use the Services, which may include: search queries, IP address, device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL, or cookies that may uniquely identify your browser.


Data Collection from Mobile Devices. We use embedded scripts and tools to collect information from mobile devices. This information can include identification numbers assigned to your mobile device, such as the ID for Advertising (IDFA) on Apple devices, and the Advertising ID on Android devices, hardware model, operating system and version, mobile network information, and website usage behavior. We may also use technologies not listed here that collect similar information for the purpose of proper functioning of the site, including such functions as security, fraud detection, and maintenance.


Information from third-party analytics providers: OTM Technologies utilizes third-party analytics tools, such as Google Analytics to automatically collect some of the information described above. These tools collect information sent by your device or our Services, including the web pages you visit, add-ons, and other information that helps us improve the Services. In order to collect this information, Google Analytics may set cookies on your browser or mobile device, or read cookies that are already there. Google Analytics may also receive information about you from apps you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics or other third-party analytics tools with personally identifiable information. Third-party analytics providers’ ability to use and share information collected by and about your visits to the Services are restricted by such third party’s terms of use. Use of Data
HOW WE USE YOUR INFORMATION.
We use personal information to provide Services to you, to improve Services, and to protect our legal rights and limit collection of personal information to that which is relevant to these purposes. We will seek your prior consent before using personal information for purposes not described in this Privacy Policy. To the extent EU data protection law applies to our processing of personal data about you as a user of our Services, we act as the "data controller". To the extent EU data protection law applies to our processing of personal data on behalf of a data processor or data controller, we serve as the "data processor".

To Provide the Services. Information you provide helps us present relevant study aids to you when you use the Services.


To Personalize Your Experience. We may use your de-identified information to understand how our Users as a group use the Service and resources provided on the Services.

To Verify Your Identity. We use your information to prevent fraud or other unauthorized or illegal activity on your account.


To Improve Our Site and App. We may study or use the information and feedback you provide to improve our Service.


To Send You E-mail. We may use your e-mail address to send you communication relating to your account including account verification, changes to our Services, technical and security notices. We may also provide communications regarding updates in our Privacy Policy. We may use your e-mail address to respond to your inquiries, questions, or other requests. To the extent permitted by applicable federal and state laws and regulations, your information may also be transferred to third-party service providers who act for on our behalf, for further study or processing in accordance with the purpose for which the information was originally collected or may otherwise be lawfully processed, such as delivery of the Services, evaluating the usefulness of the Service, evaluating improvements upon or new uses for the Service, marketing, data management or technical support.


To Comply with Legal Requirements and Protect Our Rights.When needed, we use your information to enforce this Privacy Policy, the Terms and Conditions, and any other terms that you have agreed to, including to protect the rights, property, or safety of OTM Technologies, its users, or any other person, or the copyright-protected content of the Services as well as to comply with our legal obligations.


HOW WE SHARE INFORMATION COLLECTED.

We share information collected about you with service providers that assist us with the provision of our Services, or as necessary to comply with our legal obligations. We may also share information collected about you in connection with a business transaction. We also process and share information in an aggregated, de-identified manner, where the information is shared as part of a statistical report and does not contain personal information. Please see the section “Cookies and other technologies” below for information about the technologies that we and third parties use to collect information, and to learn about options in connection with such technologies.


With service providers. We share your information with service providers to perform functions and process your data and to help provide our Services, consistent with this Privacy Policy. The legal basis for this sharing of your information is our legitimate interest in providing our Services efficiently.


With our affiliates and in connection with a business reorganization. We may share your information with companies under common control with OTM Technologies in the ordinary operation of our business. In addition, we would share your information if we are involved in a merger, acquisition, consolidation, change of control or sale of all or a portion of our assets or if we undergo bankruptcy or liquidation. The legal basis for this sharing is our legitimate interest in carrying out our business operations.


In order to comply with our legal obligations, and to protect our rights and those of others. We share your information, per your instructions, in order to prevent fraud or abuse to our Services, to protect your rights, to comply with our legal obligations and to protect our rights. The legal basis for this sharing is compliance with the law and our legitimate interest in the prevention of fraud, compliance with legal obligation and the protection of the rights of others.


Pursuant to your instructions.When requested, we will share or facilitate the sharing of your information with third parties pursuant to your instructions. We do not have any legal relationship with such parties. You are responsible for entering into separate contractual arrangements with such third parties binding them to comply with data protection obligations. These third-party data processors are not service providers or sub-processors and we shall not bear any responsibility or liability for sharing information with such parties. The legal basis for this sharing is necessary for the performance of our contract with you.


To prevent fraud and abuse of the Services. We will share information to prevent or detect fraud or to address technical issues and, if we believe it is necessary, to investigate, prevent, or take action regarding situations that involve abuse of the Services infrastructure or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of the website infrastructure or the Services generally).


To protect your rights.We will share information in an emergency or to protect the safety of any person and, if we believe it is necessary, in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.


To protect our rights and comply with our legal obligations. We will share information if we are legally required to do so, such as in response to court orders or legal process (e.g., a court order or subpoena), or to establish, protect, or exercise our legal rights or to defend against legal claims or demands, or to comply with requirements of mandatory applicable law. We will also share information as necessary to enforce this Privacy Policy, the Terms and Conditions, any other terms that you have agreed to, including to protect the rights, property, or safety of OTM Technologies, its users, or any other person, or the copyright-protected content of the Services.


Sharing information with social media services. If you have given permission in connection with using third-party services for the purpose of signing in, or on your preferences set with a third-party service, some information about you can be shared with social media services and with others through third-party services and may be published by them or may be shared by default. A third-party service’s use of information collected from you (or as authorized by you) is governed by the third-party service’s privacy policies and your settings on the relevant service, and that our use of such information is governed by this Privacy Policy and your Services account settings.


HOW WE PROTECT USER INFORMATION.

We take reasonable precautions, appropriate to the applicable risk, to protect your personal information. If OTM Technologies learns of a security systems breach, we will notify you as required by applicable law so that you can take appropriate protective steps. Please keep in mind that the Internet is not a 100% secure medium for communication. Although we endeavor to provide reasonable security for your information, no security system can prevent all potential security breaches.


WHERE INFORMATION IS PROCESSED.

The internet is a global environment. Using the internet to collect and process personal information often involves the transmission of data across borders. This means that your information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those where you are located. OTM Technologies is based in the United States. When you use our Services you consent to the processing and transfer of information in and to the United States and other countries. If you are a user based in the U.S. and you use the Services while you are abroad, your information may be available to law enforcement or to the government of that country. By registering for and using the Services you consent to the transfer of information to the U.S., the use and disclosure of this information is described here, in this Privacy Policy.


WHAT CAN YOU DO ABOUT HOW WE USE YOUR INFORMATION?

E-mail communication. Users may opt out of receiving promotional e-mail communication from OTM Technologies via the "unsubscribe" link found at the bottom of each e-mail, or by sending an opt-out request to us at privacy@mathchimp.ai with the word “unsubscribe” in the e-mail subject line. We will continue to send you notifications necessary for the Services to the e-mail address in our records.


Deleting your account. You may request that we delete your Services account by e-mailing us at privacy@mathchimp.ai. If you choose to delete your account, we will delete relevant information from our systems, except as may be necessary to retain in order to fulfill our contractual or legal obligations to you or third parties.


Cookies and other technologies.We do not control how third parties use your information, but you can opt out of certain third-party activities at the links below. Please note that we do not endorse, and we may not use, all of the services listed. These actions may not opt you out of being serviced advertising; you will continue to receive generic ads as you navigate the internet.


Google Ads: To control the types of ads Google presents to you in its advertising network, follow the instructions to block certain ads.


Google Analytics: You can opt out of Google Analytics here.


Interest-based advertising generally: Industry solutions allow you to opt out of certain ad features more broadly across various third parties. To opt out of interest-based advertising or to learn more about the use of this information, you can visit the Network Advertising Initiative, the Digital Advertising Alliance, or in Europe, Your Online Choices.


Browser: You may be able to instruct an internet browser to refuse all cookies or indicate when a cookie is set on your device. Please refer to cookie-specific preferences in your browser’s settings if you wish to set these preferences.


HOW LONG DO WE KEEP YOUR INFORMATION?

We will retain your information for as long as: (i) your account is active; (ii) needed to provide you services; (iii) necessary to comply with our contractual and legal obligations; (iv) needed to resolve disputes and enforce our agreements; or (v) where allowed, we deem appropriate in aggregate and/or de-identified form unless you or your parent or guardian request that it be deleted. OTM Technologies will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer periods.


State-Specific Rights. If you are a resident of one of certain U.S. states, you may have the ability to exercise additional rights and choices in connection with the data described in this document. We will take reasonable steps to accommodate these requests when made, but this may require additional verification steps in order to do so. may need to verify your identity before doing so.

Sensitive Data – If you are a Virginia, Colorado, or Connecticut resident we will obtain your consent to process any of the Sensitive Data we collect (as defined by the applicable state law). If you are a resident of Utah, we will notify you at or before the time of collection of Sensitive Data (as defined by Utah law) and an opportunity to opt out. Opt-Out of Sales of Your Personal Data– If you are a Colorado or Connecticut resident and would like to opt out of the sale of your personal data, please complete this form.


Right to Appeal – Residents of Colorado, Connecticut, and Virginia have the right to appeal our determinations relating to these requests. You can do so by sending your appeal by e-mail to privacy@mathchimp.ai.


Your Data Protection Rights and The Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)

We comply with applicable data protection laws and value your right to privacy. In furtherance of our obligations to you that flow from our data collection practices, if you are resident in the European Economic Area you are entitled to the following rights:


• Right of access. You have the right to request copies of your personal information. We may charge you a small fee for this service.

• Right of rectification. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.

• Right to be forgotten. You have the right to request that we erase your personal information, under certain conditions.

• Right to restriction of processing.You have the right to request that we restrict the processing of your personal information, under certain conditions.

• Right of portability. You have the right to have the data we hold about you transferred to another organization.

In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety or fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.


You may access your Service account to access, correct or delete the information you provided to us and which is associated with your account. For instructions on accessing your information or otherwise for assistance with these rights please e-mail us at privacy@mathchimp.ai. In the event that we refuse a request under rights of access, we will provide you with a reason as to why. If you make a request, we will respond within one month of receiving your request.


NOTICE TO EUROPEAN RESIDENTS – LAWFULNESS OF PROCESSING.

We collect, use, and otherwise process your personal information based on the following:


• Based on your consent. In some cases, at the point at which you provide personal information, we may ask you for your consent to collect and process your personal information. Disclosure of Data

Under certain circumstances, OTM Technologies LLC may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

OTM Technologies LLC may disclose your Personal Data in the good faith belief that such action is necessary to:

• To protect and defend the rights or property of OTM Technologies LLC

• To prevent or investigate possible wrongdoing in connection with the Service

• To protect the personal safety of users of the Service or the public

• To protect against legal liability


Security of Data

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.



NOTICE TO CALIFORNIA RESIDENTS

Note: The following section applies to residents of California only.


California Shine the Light Law. Residents of the State of California have the right to ask companies conducting business in California to provide them with a list of the types of personal information that they have disclosed during the preceding year to third parties for the third parties’ direct marketing purposes, and the identity of those third parties. Note that OTM Technologies does not disclose any personal information to third parties for their direct marketing purposes.


California Consumer Privacy Act. Under the California Consumer Privacy Act (“CCPA”), if you are a California resident, or an authorized representative of a California resident (see “Authorized Agents,” below), you have the following rights regarding your personal information:


1. The right to request disclosure of:

• the categories and specific pieces of personal information collected about you;

• the categories of sources from which your personal information is collected;

• the business or commercial purpose for collecting or selling or personal information; and

• the categories of third parties with whom the business shares your personal information.

2. The right to request deletion of any personal information collected about you.


3. The right not to be discriminated against because you have exercised any of these rights.


To submit a disclosure or deletion request (rights #1 and #2 above), please contact us at privacy@mathchimp.ai. Please include “CCPA Request” in the subject line of your e-mail and include your name and whether your request is a “request for disclosure” or a “request to delete.”


Please note: We do not sell personal information to third parties. We only share information to third parties in a de-identified and/or aggregate format, at your direction, or to third-party service providers that process information on our behalf.


Verification: Before responding, we will verify your request by comparing the information you submit with the request to information related to your account. In some cases, we may request additional information to confirm that we have identified the correct records in our system. Subject to certain exceptions that may apply in the CCPA, if we are able to verify your request, we will accommodate your request. If we are unable to accommodate your requests fully, we will provide you additional information about the reasons that we could not fully comply with your request.


Authorized Agents. You may also designate an agent to exercise your rights, or the rights of your minor child, under CCPA as described above. We will take steps to verify both (1) the identity of the person seeking to exercise their rights as listed above and (2) that your agent has been authorized to make a request on your behalf by providing us with a copy of a signed written authorization or a copy of a power of attorney. We may deny a request received from an authorized agent if we cannot verify that you authorized the agent to act on your behalf. If the authorized agent does not provide a valid power of attorney, we may, at our discretion, ask that you verify your identity with us directly before fulfilling a request received from an authorized agent.

Our Policy on "Do Not Track" Signals under the California Online Protection Act (CalOPPA)

Nevada S.B. 220 provides consumers with the ability to opt out of the sale of their personal information. We do not sell your personal information as defined in S.B. 220. VCDPA Appeals


Pursuant to the VCDPA, if, for any reason, you would like to appeal our decision relating to your request, you have the right to submit an appeal and can do so by e-mailing us at privacy@mathchimp.ai or following the instructions contained in the communication of our initial decision relating to your request. Please include your full name, the basis for your appeal, and any additional information to consider.


Service Providers

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.


Payments

We may provide paid Services. In that case, we use third-party services for payment processing (e.g. payment processors).


We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.
